IMPORTANT: THIS SOFTWARE END USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU AND FIRSTBORN INTERACTIVE. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE. IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT.

SOFTWARE PRODUCT LICENSE

Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect this SOFTWARE PRODUCT. This SOFTWARE PRODUCT is licensed, not sold and is wholly owned by Firstborn Interactive.

SCOPE OF LICENSE GRANT.

You may:

Use the Shareware version of this Software on any computer for personal use only.

Copy and/or distribute the Shareware (non-registered) version of this software provided it is not altered it in any way.

You may not:

Modify, translate, reverse engineer, de-compile, disassemble, or create derivative works based on the Software.

Remove any proprietary notices, labels, trademarks on the software or documentation.

Copy or distribute the full (registered) version of the software.

Rent, lease, grant a security interest in, or otherwise transfer rights to the Software; or

Remove any proprietary notices or labels on the Software.

You are specifically prohibited from charging, or requesting donations, for any such copies, however made; from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission.

REGISTERED VERSION

A single registered copy of Rollerdex may either be used by a single person who uses the software himself on one or more computers, or installed on a single computer and used by multiple people, but not both.

TITLE.

Title, ownership rights, and intellectual property rights in the Software shall remain in Firstborn Interactive and/or its suppliers. The Software is protected by copyright and other intellectual property laws and by international treaties. Title and related rights in the content accessed through the Software is the property of the applicable content owner and is protected by applicable law. The license granted under this Agreement gives you no rights to such content.

LIMITED WARRANTY

This software and documentation are sold "as is" without any warranty as to their performance, merchantability or fitness for any particular purpose. The licensee assumes the entire risk as to the quality and performance of the software. Firstborn Interactive warrants that the diskettes on which the Program is furnished will be free from any defects in materials. Exclusive remedy in the event of a defect is expressly limited to the replacement of diskettes. In no event shall Firstborn Interactive or anyone else who has been involved in the creation, development, production, or delivery of this software be liable for any direct, incidental or consequential damages, such as, but not limited to, loss of anticipated profits, benefits, use, or data resulting from the use of this software, or arising out of any breach of warranty.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, THAT YOU UNDERSTAND THIS AGREEMENT, AND UNDERSTAND THAT BY CONTINUING THE INSTALLATION OF THE SOFTWARE, BY LOADING OR RUNNING THE SOFTWARE, OR BY PLACING OR COPYING THE SOFTWARE ONTO YOUR COMPUTER HARD DRIVE OR RAM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU FURTHER AGREE THAT, EXCEPT FOR WRITTEN SEPARATE BETWEEN FIRSTBORN INTERACTIVE AND YOU, IF ANY, THIS AGREEMENT IS A COMPLETE AND EXCLUSIVE STATEMENT OF THE RIGHTS AND LIABILITIES OF THE PARTIES HERETO. THIS AGREEMENT SUPERSEDES ALL PRIOR ORAL AGREEMENTS, PROPOSALS OR UNDERSTANDINGS, AND ANY OTHER COMMUNICATIONS BETWEEN FIRSTBORN INTERACTIVE AND YOU RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
